China Release Letter Timing: When It Should Be Issued and How Long It Lasts

When should a China employment-exit certificate be issued? Learn what the separate 15-day rule covers and why local permit deadlines are not its expiry date.

Short answer

Timing and validity

Article 50 of the Labor Contract Law says the employer shall issue the written certificate at the time the labor contract is revoked or terminated. The same article gives a separate 15-day period for transfer formalities involving the worker’s personal file and social-insurance account; it does not say the employer may wait 15 days to issue the certificate.

The national provisions cited here do not state a universal expiry period for the employment-exit certificate. Work-permit, residence, and new-employer procedures can impose their own filing windows or document requirements, so act on the current local checklist rather than treating the certificate as indefinitely sufficient for every purpose.

Questions this guide answers

  • How long does an employer have to issue a release letter in China?
  • Can it be issued before the final working day?
  • When should the former employer give it to me?
  • How long is a China release letter valid?
  • Do I get one when a fixed-term contract expires?
  • Do I still get one if I resign, break the contract, or leave during probation?

The issue date and the 15-day rule are different

The core timing sentence is direct: the certificate is issued when the labor contract is revoked or terminated. Article 50 then addresses other transfer formalities within 15 days. Mixing those two duties is a common source of delay.

Put the actual last day, certificate delivery date, work-permit cancellation date, final payment date, and residence deadline on one timeline. They may not be the same day.

Can the employer prepare it before the final day?

HR can prepare a draft or arrange handover before the final day, but the certificate should accurately record the actual date the labor relationship ends. Be cautious with a prematurely dated document or wording that turns a disputed dismissal into a voluntary resignation.

If an authority or new employer needs a document before the final day, ask what interim record it will accept and whether the completed certificate must follow after termination.

Does the certificate expire?

The national certificate provisions cited here do not give the paper a stated validity period. That is different from asking whether a particular work-permit office will accept an old certificate or whether a new application must be filed within a local deadline.

For example, Beijing’s changing-employer page publishes timing rules for particular new work-permit routes after cancellation. Those are procedural application windows, not a national statement that every employment-exit certificate expires on the same day.

Contract expiry, resignation, probation, and breach

The duty concerns the end of the labor contract, not whether the employer is pleased with the exit. A fixed-term expiry, employee resignation, mutual termination, employer termination, or probation exit can change severance and dispute issues, but the employee should still ask for accurate written proof of how and when the employment ended.

If the route is disputed, preserve the notices and do not let the exit certificate silently rewrite the history. Get advice quickly when a permit deadline or significant claim depends on the wording.

Direct answers

Frequently asked questions

Does the employer have 15 days to give me the certificate?

Article 50 states that the certificate is issued at termination. Its 15-day language addresses personal-file and social-insurance transfer formalities.

Can I ask for it before my last day?

You can ask and review a draft, but the final certificate should accurately record the actual end of employment.

How long is it valid?

The national certificate rules cited here do not state one universal expiry. The intended filing may have a separate local deadline or recency requirement.

Do I get one after natural contract expiry?

The statutory language covers revocation or termination. Ask for the certificate when a fixed-term contract ends as well as when it ends early.

Can an employer delay it because handover is unfinished?

Article 50 separates the certificate duty from the employee’s agreed handover and from payment of any required financial compensation after handover.

What if the delay causes me loss?

Article 89 provides for rectification and states that the employer is liable for compensation if its failure to issue the certificate causes harm. Evidence and causation will matter.
