Recently, the court in Huizhou City, Guangdong Province, tried a case involving a foreigner to disseminate obscene articles and sentenced the suspect to detention for three months for spreading obscene articles. He will be expelled from China after three months’ detention.

After investigation, within half a year after September 2018, this foreign man repeatedly used his mobile phone WeChat account to forward 54 obscene videos to his WeChat friends and WeChat group.

After hearing the case, the court held that the foreigner’s legal awareness was weak and that the dissemination of pornographic information in China would be seriously dealt with.

Even if the dissemination of pornographic information is not for money, the use of the Internet and mobile communication terminals (instant messaging software) to disseminate obscene information (video and other forms) to others, they are serious in China.

At first, the defendant did not think that his behaviour had any serious mistakes. He even thought that this was a normal human exchange of ideas and information.

However, someone reminded him that he would be detained for a longer period of time if he did not obey the Chinese police and legal ruling. Later, the foreigner truthfully confessed that his actions were criminal acts. Although the foreigner has a frankness and voluntarily pleads guilty, the scope and quantity of obscene articles are relatively small, and they can be punished according to law.
